I am currently looking to purchase a holiday apartment in Bansko and have been hearing some horror stories about hidden debts and fake property titles. Could anyone share their experiences or advice on how to verify a seller's legitimacy before signing a preliminary contract? I want to make sure I don't fall victim to common scams that seem to be circulating in the Bulgarian market right now.

Bansko is notorious for these issues. My biggest advice is to never use the developer's lawyer. Always hire an independent one to conduct a thorough title search at the Property Registry. You should read about the Legal Process of Buying Real Estate in Bulgaria to understand exactly what they should be checking for you before you put down any deposit.

I learned the hard way. Make sure to check the 'Act 16' status of the building. If it doesn't have it, you're essentially buying a construction site, not a holiday apartment. Scammers often gloss over this detail.

Always ask for a recent 'Certificate of Encumbrances' (Tezhesti). It shows any mortgages or legal claims attached to the property. If the seller refuses to provide a fresh one from the Registry Agency, walk away immediately.

Don't trust 'exclusive' deals or high-pressure tactics. If someone says there are ten other buyers waiting, it's a red flag. Take your time, visit the local municipality, and verify the tax status of the property yourself.

I've seen so many people get burned by fake power of attorney documents. Ensure that the person selling the property has a valid, notarized authorization if they aren't the registered owner.

If you are also looking at coastal options, make sure to do your research on the area's growth potential. For instance, check out Is buying property in Sozopol still a smart investment in 2024? because the market dynamics there are quite different from the ski resorts in Bansko.

Be very wary of 'hidden debts' like unpaid maintenance fees to the complex management company. These can be massive in some of the bigger Bansko complexes and they become your problem the moment you take the title.

Never sign a preliminary contract without a lawyer reviewing the 'Notarial Deed' (Notalen Akt) draft. Ensure the property description matches the cadastral map exactly, or you might find yourself owning a smaller square footage than advertised.

Ask to see the utility bills for the last two years. If the seller can't provide them, it's often a sign that the property has been neglected or that there are issues with the building's infrastructure that they are trying to hide.
